A property easement is a right to use a specific part of a property for a designated purpose. Conditions of an easement may be contained in the property deed or may be established in a separate document to prevent disputes.

Types of Easements

There are two types of easements: express easements and implied easements.

An express easement is for example, conditions allowing a utility company to run power lines on a property. Neighbors may enter into an express easement agreement allowing them to share a driveway extending over both property lines.

An implied or prescriptive easement exists when the use of a property continues over a specific period of time with or without verbal permission from the land owner.
