Prenuptial Agreement

Some couples choose to include prenuptial agreements in their estate plans to protect their assets and avoid expensive divorce litigation. To help you meet your financial goals, you need the assistance of a financially savvy lawyer.

You can find sophisticated legal representation at Musser Love, P.C. in Ann Arbor. The laws that govern pre- and postnuptial agreements change frequently, and our attorneys can draft and litigate agreements that are customized to your unique needs.

What is a Prenuptial Agreement?

A prenuptial agreement is a legal contract that lists the assets and debts each person has before the marriage. It establishes what each person’s property rights will be if the marriage ends in divorce or death. In Michigan, prenuptial agreements must be signed before the marriage. The agreement can address spousal support and property division, but not child custody or child support.

There must be full and fair disclosure of all debts and assets from each party when creating the agreement. If assets are not disclosed or the agreement is not prepared in a proper manner, it will not be enforceable.

Postnuptial agreements are not automatically enforceable. We can help guide you as to whether such an agreement is of benefit to you, in your particular situation. A one-size-fits-all approach is not a good idea because it will not meet your specific needs.

At Musser Love, we take the time to understand exactly what you want and customize an agreement to fit your needs. We also remain aware of the changing law in this area.
